DECLARATION OF CONDOMINIUM as adopted January 2, 2006
and amended December 2, 2008, December 7, 2009, January 23, 2012 and December 7, 2021.

11. AMENDMENT. Except for alterations in the share of unit owners in the common elements, for which provision is contained in Paragraph 3G(l) the condominium documents may be amended in the following manner:

A Declaration of Condominium. Amendments to the Declaration of Condominium shall be proposed and adopted in the following manner:

(1) Notice. Notice of the subject matter of the proposed amendment shall be included in the notice of any meeting at which a proposed amendment will be considered.

(2) Resolution. A resolution adopting a proposed amendment may be proposed by either the Board of Directors of the Association or by the unit owners of the Association. After being proposed and approved by one of such bodies, it must be submitted to all owners for approval within 60 (sixty) days. Unit owners not present at the meetings considering the amendment may express their approval in writing. Such approval must be not less than two-­ thirds (2/3rds) of the votes of the members of the Association present in person or by proxy, and voting at a duly called meeting of the Association. However, if it appears that an amendment is necessary due to a defect, error or omission in any of the condominium documents, none of which will materially or adversely affect the property rights of unit owners, then a majority vote of the owners shall be required in lieu of the two-thirds {2/3rds) stated above.

(3) Recording. A copy of each amendment shall be certified by the officers of the Association as having been duly adopted and shall be effective when recorded in the public records of Lee County, Florida

(4) Extraordinary Amendment. No amendment may be made which shall change the size or shape of any condominium unit, or any other appurtenances thereto, or the proportion, or percentage of ownership in the common area or common surplus, if any, unless approved by all of the unit owners and the owners or holders of any liens or encumbrances affecting the individual units or the common area; all of whom shall join in the execution of any such amendment.

B. Association ByLaws. The ByLaws of the Association shall be amended in the manner provided by such documents. Such amendments shall become effective upon their being recorded in the public records of Lee County, Florida.
